What the rule says
Since June 25, 2021, upholstered furniture manufactured, imported or reupholstered for the US market must meet California Technical Bulletin 117-2013 (smolder resistance), which Section 2101 of Pub. L. 116-260 made a federal standard. Each product must carry a permanent label reading "Complies with U.S. CPSC requirements for upholstered furniture flammability"; the labeling requirement became mandatory June 25, 2022. The rule preempts other state fire-related flammability requirements for upholstered furniture, except California's 4 CCR 1374, 1374.2 and 1374.3 and TB 117-2013, and does not preempt state health-risk laws not designed to prevent fire. Mattresses, foundations, bedding products and exercise furniture are not covered, and products subject to the standard are not subject to CPSA section 14(a) certification for it.
