Customs proposes new rules for shipments of $2,500 or less; comments due December 7, 2026

U.S. Customs and Border Protection proposed new rules for low-value shipments, meaning goods worth $2,500 or less. It would add data and bond requirements for certain "informal" entries, require them to be filed electronically on or before the day of importation, and create a new electronic informal entry type for mail shipments. A consignee that is not the owner or buyer would have to appoint a licensed customs broker as importer of record. The duty-free de minimis exemption has been suspended since at least August 29, 2025 (since May 2, 2025 for China), and the law ends it on July 1, 2027, so Customs expects more goods to move through these entries. Comments are due December 7, 2026. A furniture business that brings in parts, samples or small online orders should check whether its shipments would be affected (this is a summary, not legal advice).

Section 301 China tariffs stay in place while USTR starts its four-year review

The U.S. Trade Representative said the two Section 301 actions on China, from July 6 and August 23, 2018, did not end on their four-year dates in 2026. Domestic industries asked for them to continue, so they stay in effect and could still be changed. USTR will run a four-year review and publish later notices describing the process, which will invite public comments. This notice does not list products or change any rate. A furniture business that imports from China should check whether its HTS codes are on the Section 301 China lists and watch for the review notice (this is a summary, not legal advice).

Customs seeks comments on its IEEPA tariff refund tool (CAPE); comments due November 4, 2026

On February 20, 2026 the Supreme Court ruled that tariffs charged under the IEEPA law were unlawful. A trade court then ordered refunds of IEEPA duties with interest, by having Customs finalize entries without those duties. It paused that order to the extent it requires immediate compliance, so Customs can build its system. Customs is building a tool called CAPE inside its ACE system so importers of record, or their licensed customs brokers, can ask for refunds. A request is a CSV file of entry numbers, up to 9,999 entries per request. Refunds go out electronically by ACH, and Customs is holding refunds for filers with no ACH account on file in ACE. The court order covers entries that are not yet liquidated, or liquidated but not final. This notice asks for public comments on the refund worksheet by November 4, 2026. A furniture importer that paid IEEPA tariffs between February 3, 2025 and February 24, 2026 should ask its customs broker about filing, and check its ACE account, ACH details and entry list (this is a summary, not legal advice).

Canada: 50% duty widens to more furniture, seat and mattress lines on September 15, 2026

A new proclamation changed the list of Canadian goods that carry the extra 50% duty (the motor-vehicle dispute list). It adds many more furniture and bedding lines: seats that convert into beds, bent-wood, plastic, bamboo, rattan and cane furniture (9403), more kinds of seats and seat parts (9401), mattress supports (9404.10) and mattresses (9404.21 and 9404.29). It also removes eight non-furniture lines, such as salt, Portland cement, refined lead and fishing rod parts. The changes apply to goods entered on or after 12:01 a.m. Eastern on September 15, 2026. The proclamation says the 50% duty applies in addition to Section 232 duties. The first proclamation had said it did not apply to articles subject to Section 232 duties. A furniture or mattress business that buys from Canada should check each product's HTS code against Annex I, Part A (added) and Part B (removed), and plan for the added cost (this is a summary, not legal advice).

Canada: extra 50% duty on certain furniture and seats starts August 22, 2026

The President ordered an extra 50% duty on a list of Canadian products, in a dispute over Canada's tariffs on U.S. motor vehicles. The list in Annex II includes some furniture and seats: wooden furniture (9403.60.80), wooden bedroom furniture (9403.50.90), metal furniture other than office furniture (9403.20.00), plastic furniture (9403.70.80), non-teak wooden-frame chairs that are not upholstered (9401.69.60), swivel seats with height adjustment and no wooden frame (9401.39), metal-frame seats (9401.71, 9401.79) and parts. The duty was set for August 19, 2026, paused for three days, and began at 12:01 a.m. Eastern on August 22, 2026. As first issued, it is added to other duties but does not apply to articles that are subject to Section 232 duties. A later proclamation, covered in the September 15 entry, added many more furniture and mattress lines and says the duty applies in addition to Section 232 duties. A furniture business that imports from Canada should check its HTS codes against the list in Annex II and the date each entry was entered (this is a summary, not legal advice).

Wooden bedroom furniture from China: final antidumping review puts 11 companies under the 216.01% China-wide rate

Commerce finished its antidumping review of wooden bedroom furniture from China for calendar year 2024. It found that 11 named companies did not show they deserve their own rate, so they are treated as part of the China-wide group. The China-wide cash deposit rate is 216.01%. It applies to shipments entered on or after August 12, 2026 from Chinese exporters without a separate rate. Exporters that already have a separate rate keep their existing deposit rate. No earlier than 35 days after the notice, Commerce plans to tell Customs to finalize (liquidate) the 2024 entries from those 11 companies at 216.01%. Importers must also file a certificate that they did not reimburse antidumping duties before those entries are finalized. Without it, Commerce may presume reimbursement and charge double antidumping duties. A furniture business that buys Chinese wooden bedroom furniture should check which exporter it uses, which cash deposit rate applies to that exporter, and whether older entries are about to be finalized (this is a summary, not legal advice).

Commerce cancels duty reviews on Chinese mattresses, wooden bedroom furniture and wooden cabinets

Commerce cancelled (rescinded) a list of antidumping and countervailing duty reviews because everyone who asked for them withdrew the request. The list covers many products. It includes the antidumping review of Chinese mattresses (review period Dec. 1, 2024 to Nov. 30, 2025), the antidumping review of Chinese wooden bedroom furniture (calendar 2025), and reviews of Chinese wooden cabinets and vanities (antidumping, Apr. 1, 2025 to Mar. 31, 2026, and countervailing duty, calendar 2025). Commerce will have Customs charge duties at a rate equal to the cash deposit paid when the goods entered. It intends to send those instructions no earlier than 35 days after the August 11, 2026 notice. In plain terms, the final bill for those periods should match the deposits importers already paid. A furniture or mattress importer should check its entries from those periods (this is a summary, not legal advice).

Mattresses from Malaysia: final antidumping review sets 42.92% rate for six companies

Commerce finished its antidumping review of mattresses from Malaysia for May 1, 2024 to April 30, 2025. It found the mattresses were sold below normal value and set a 42.92% dumping margin for six named producers or exporters (CS Vision Supply, Orient GIC Global, Pinnacle Salute, Premier High Ventures, Lion YTT World and Weld Tack Industries) and for five other companies that were not individually examined. For these companies the cash deposit rate is 42.92% for shipments entered on or after August 11, 2026. For other Malaysian exporters the notice sets three rules: an exporter covered in an earlier review keeps its company-specific rate, an exporter not covered anywhere takes the rate of its producer if the producer was covered, and everyone else pays the 42.92% all-others rate. Commerce plans to send final-duty instructions to Customs no earlier than 35 days after the notice. A mattress importer should check which Malaysian producer and exporter handled its mattresses and which cash deposit rate applies (this is a summary, not legal advice).

Mattresses from six countries: Commerce finds dumping would likely continue if the antidumping orders ended

Commerce finished fast (expedited) five-year reviews of the antidumping orders on mattresses from Cambodia, Malaysia, Serbia, Thailand, Türkiye and Vietnam. No respondent sent a substantive response, so Commerce used the 120-day fast track. It found that ending the orders would likely lead to dumping continuing or coming back. The dumping margins likely to prevail are up to 103.79% for Cambodia, 42.92% for Malaysia, 112.11% for Serbia, 763.28% for Thailand, 20.03% for Türkiye and 668.38% for Vietnam. The notice was signed July 28 and published July 31, 2026. A mattress importer should check which of these countries its mattresses come from and which cash deposit rate applies (this is a summary, not legal advice).

Mattresses from China: Commerce finds subsidies would likely continue if duty order ended (97.78%)

Commerce finished a fast (expedited) first five-year (sunset) review of the countervailing duty order on mattresses from China. No Chinese government or company respondent sent a substantive response, so Commerce used the 120-day fast track. It found that ending the order would likely lead to subsidies continuing or coming back, at a net subsidy rate of 97.78% for Kewei Furniture Co Ltd, Zinus Xiamen, Ningbo Megafeat Bedding Co., Ltd., Healthcare Co. Ltd and all other producers. This is the rate Commerce says would likely prevail if the order ended. The notice does not set a cash deposit rate. It was signed July 21 and published July 24, 2026. A mattress importer should check whether any product it buys is made in China and what duty deposit applies (this is a summary, not legal advice).

    • New tariff

Section 301 tariffs of 10% or 12.5% on goods from 60 economies start July 24, 2026

The U.S. Trade Representative put new Section 301 tariffs on products of 60 economies. Seventeen economies, including Canada, Mexico, India, Indonesia, Malaysia, Cambodia and the United Kingdom, pay 10%. For the European Union and Taiwan, the new tariff is only the gap between a product's normal (MFN) duty and 10%. For Japan, South Korea and Switzerland it is the gap up to 12.5%. If the normal duty is already that high, the new tariff is zero. The other 38 economies, including China, Vietnam, Thailand, Brazil, Türkiye and the Philippines, pay 12.5%. The tariffs apply to goods entered on or after 12:01 a.m. Eastern on July 24, 2026. Goods loaded on a vessel and in transit before that time are not charged if they were entered before 12:01 a.m. Eastern on July 28, 2026. Also not charged: articles of steel, aluminum or copper, vehicles and vehicle parts, semiconductors, the wood products named in the notice, and Canadian or Mexican goods entered duty-free under USMCA. A furniture business should check each product's country of origin, the exemption lists in Annexes I and II, and the other tariffs already on it (this is a summary, not legal advice).
